DirectCareHub terms of use
We are DirectCareHub Limited (company number 11460332) of 1 Middle Platt, Warehorne Road, Hamstreet, Ashford, Kent TN26 2JL.
We have developed a smartphone app (the app) to enable care providers and care workers to contact each other and to arrange for care workers to provide care services at care providers on a self-employed basis
You are a user of the app, whether representing a care home or acting as a care worker
These are the terms on which you may use the app:
- 1 The contracts for services arranged between the users of the app is entirely between such users. We accept no responsibility for the terms of such contracts nor for their fulfilment: we are merely acting as introducers and facilitators
- 2 Our responsibility is to provide the app for use by users and to maintain it to the best of our ability, without liability if circumstances beyond our direct control interfere with this, and with our liability in other circumstances limited (except as prohibited by law) to the aggregate fees paid to us during the latest 12-months period by the relevant care home or in respect of the relevant worker
- 3 We will ensure that all personal data shared via the app is kept secure on our servers and will not disclose that data to any person without the consent of the data subject
- 4 You consent to such personal data as you submit via the app being disclosed to other users of the app for the purposes envisaged by the app

- 6 You agree that a contract for services is created when a care worker accepts an offer of work from a care home manager via the app
- 7 If the care home cancels an accepted offer of work more than 3 hours but less than 12 hours before the work start time, the care home will be liable to pay the care worker 50% of the agreed fee; if such cancellation is less than 3 hours before the start time, the full fee is payable
- 8 We may at any time prevent a user from using the app without giving a reason, though this will usually be (in the case of a care home) for persistent or unjustified non-payment or delayed payment of fees or (in the case of a care worker) for persistent or unjustified failure to attend for agreed work
- 9 Our own fees are payable by the care provider to us directly. The fee payable by the care provider to us will be the equivalent of 1 hour of the carers/nurses negotiated rate with the care provider.
- 10 The app can be used to generate invoices. The parties can adjust the default settings as they agree between themselves
- 11 It is the care providers responsibility to check the accuracy of the workers’ CVs and claimed qualifications and to ensure workers are suitable for the work they are being offered
- 12 The app can be linked with other proprietary software, but we accept no liability for any problems that may arise as a result of such links
- 13 We may alter these terms from time to time, and will publish the latest version on our website at www.directcarehub.co.uk/terms-conditions.php
- 14 The contract between you and us is governed by English law and is subject to the exclusive jurisdiction of the English courts
